2. Scope of This Policy
This policy covers personal information about visitors, prospective clients, clients, and their representatives. It does not cover third-party websites, media outlets, or platforms, which have their own privacy policies. When we process personal information on behalf of a client (for example, a client's customer list for a campaign), Section 10 applies.
3. Personal Information We Collect
3.1 Information you give us
Contact and identity details, such as your name, email address, phone number, business name, job title, and mailing address.
Order and billing details, such as the services you buy, invoices, and billing address. Card payments are handled by our payment processors, and we do not store full card numbers.
Content for your project, such as press releases, biographies, photos, logos, manuscripts, quotes, and testimonials.
Communications, such as messages, emails, form submissions, and, with notice to you, call or meeting recordings and transcripts.
Consent records, such as the form you used, which consent boxes you checked, the consent wording shown to you, and the date, time, and IP address of your consent.
Communication and accessibility preferences, including any accommodation request you choose to share.
3.2 Information collected automatically
When you use the Site, we and our service providers may automatically collect your IP address, browser and device type, pages visited, referring website, date and time of visits, approximate location based on IP address, and message delivery status. We use cookies, pixels, and similar technologies to do this, as described in Section 13.
3.3 Information from other sources
We may receive information about you from scheduling and payment tools you use to book or pay us, from a person who referred you to us, and from social media platforms when you interact with our pages, subject to your settings on those platforms.
4. Sensitive Information
We do not ask for sensitive information such as health information, government identification numbers, or financial account details, other than what our payment processors need to take payment. If you choose to share disability-related information to request an accommodation, we use it only to provide that accommodation and share it only with team members who need it. You never need to disclose a diagnosis. Please do not include sensitive information in Content unless you want it published.
5. How We Use Personal Information
We use personal information to:
respond to inquiries, book consultations, and provide quotes;
deliver our services, including writing, submitting, and publishing Content you approve;
send non-marketing text messages about appointment and consultation reminders, project and order updates, publication confirmations, billing notices, and customer support, if you opted in to them;
send marketing text messages about special offers, discounts, and service updates, only if you separately opted in to them;
send marketing emails where you have consented or the law otherwise permits;
process payments, keep accounting records, and meet tax obligations;
provide disability accommodations and communicate in the way you prefer;
keep records of consent and opt-out requests, and honour those requests;
protect the Site, prevent fraud and misuse, and enforce our Terms of Service;
understand how the Site is used so we can improve it; and
comply with legal obligations and respond to lawful requests.
We will not use personal information for a new purpose without telling you and, where required, obtaining your consent.
6. Consent and Legal Bases
6.1 Your consent. We rely on your consent to collect, use, and disclose personal information, except where the law allows otherwise. Consent may be express (for example, checking a box) or, where appropriate, implied (for example, giving us your email address so we can reply to your question).
6.2 Withdrawing consent. You may withdraw consent at any time, subject to legal or contractual limits, by emailing hello@blastily.com, replying STOP to a text message, or using the unsubscribe link in an email. If you withdraw consent needed to deliver a service, we will explain how that affects the service. Withdrawing consent does not affect processing that happened before you withdrew it.
6.3 Marketing is never required. We never require consent to marketing messages as a condition of buying from us or submitting a form.
6.4 Visitors in the EU and UK. Where the GDPR applies, we rely on these legal bases: performing a contract with you; your consent; our legitimate interests in running and improving our business, where these are not overridden by your rights; and compliance with legal obligations.
7. Text Messaging and Mobile Information
7.1 Separate, optional consent. Our forms offer two separate, unchecked, and optional consent boxes: one for non-marketing text messages about appointment and consultation reminders, project and order updates, publication confirmations, billing notices, and customer support, and one for marketing text messages about special offers, discounts, and service updates. You may choose one, both, or neither. We send only the types of messages you agreed to receive.
7.2 No sharing of mobile information. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
7.3 Service providers. Text messages are sent through our customer relationship management and messaging service providers and their carrier partners, who act only on our instructions to deliver messages and are required to keep your information confidential.
7.4 Opting out and help. Reply STOP to any text message to stop receiving texts from us, or reply HELP for assistance. Message frequency varies, and message and data rates may apply. Our full messaging terms are in Section 14 of our Terms of Service at https://blastily.com/termsofconditions.
7.5 Records. We keep records of your consent and any opt-out so that we can show that we have your permission and ensure we do not message you after you opt out.
8. Email Communications
Every marketing email we send identifies Blastily, includes our contact information, and includes an unsubscribe link. We process unsubscribe requests without delay and within 10 business days, as required by CASL, and in line with the U.S. CAN-SPAM Act. Even after you unsubscribe from marketing, we may still send emails needed to deliver services you have purchased, such as invoices and project updates.
9. How We Share Personal Information
We do not sell, rent, or trade your personal information. We share personal information only as follows:
Service providers. Trusted companies that help us operate, such as customer relationship management and marketing automation platforms, messaging and email delivery providers, payment processors, website hosting and domain providers, scheduling tools, cloud storage, analytics, accounting, and IT support, as well as contractors who help deliver client projects. They may use personal information only to provide services to us and must protect it.
Media outlets and publishing partners. When you order placement services, we share the Content you have approved for publication, and contact details where an outlet needs them to process or verify your placement.
Professional advisers. Lawyers, accountants, auditors, and insurers, under duties of confidentiality.
Legal and safety reasons. Where required or permitted by law, such as to comply with a court order, respond to lawful requests from authorities, protect our rights, or prevent fraud or harm.
Business transactions. In connection with a proposed or actual merger, financing, reorganization, or transfer of all or part of our business, under confidentiality obligations, and only if the recipient agrees to protect the information in line with this policy.
With your consent. In any other case, only with your consent.
None of these sharing categories include text messaging originator opt-in data and consent, which is handled as described in Section 7.2.
10. Information We Process for Our Clients
When we run campaigns, send messages, or build websites for a client, we may process personal information about that client's customers or contacts on the client's behalf. In those cases, we act as the client's service provider, and the client is responsible for having a lawful basis and all required consents. If you are a client's customer and want to access or delete your information, please contact that client directly. If you contact us, we will forward your request to them.
11. Where Information Is Stored
We are based in Canada, but some of our service providers store or process personal information in the United States and other countries. When your information is outside Canada, it is subject to the laws of that country and may be accessible to its courts, law enforcement, and national security authorities. We use contracts and other safeguards to require a comparable level of protection. Where the GDPR applies, we use appropriate transfer safeguards, such as standard contractual clauses.
12. How Long We Keep Personal Information
We keep personal information only as long as needed for the purposes described in this policy, or as required by law. As a general guide:
inquiry and prospect information: up to [24] months after our last interaction;
client, project, billing, and accounting records: for at least 6 years after the end of the tax year to which they relate, as required by Canadian tax law;
consent records: for as long as we send you messages and for [3] years afterward, so that we can demonstrate consent;
opt-out records: for as long as needed to make sure we do not contact you again;
call and meeting recordings: up to [12] months, unless needed longer for a dispute; and
information used to make a decision about you: at least one year after the decision, so that you have a reasonable opportunity to request access to it.
When information is no longer needed, we securely delete, destroy, or anonymize it.
13. Cookies, Pixels, and Similar Technologies
We use essential cookies to make the Site work, analytics tools to understand how the Site is used, and, where we choose to, advertising pixels (such as those provided by search and social media platforms) to measure and improve our advertising. Where the law requires it, we ask for your consent before using non-essential cookies. You can control cookies through your browser settings and, where available, our cookie banner. Blocking some cookies may affect how the Site works. Where required by applicable law, we honour browser-based opt-out signals such as Global Privacy Control. Because there is no common standard for "Do Not Track" signals, we do not currently respond to them.
14. Security
We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information, such as access controls, multi-factor authentication, encryption in transit, and confidentiality obligations for our team and service providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send sensitive information by text message or unencrypted email.
15. Privacy Breaches
If a privacy breach creates a real risk of significant harm to you, we will notify you and report the breach to the Office of the Privacy Commissioner of Canada or the Office of the Information and Privacy Commissioner of Alberta, and to any other authority, as required by law. We keep records of privacy breaches as required by law.
16. Your Privacy Rights
Depending on where you live, you may have the right to:
access the personal information we hold about you and learn how it has been used and shared;
ask us to correct inaccurate or incomplete information;
withdraw your consent;
ask us to delete your information, subject to legal record-keeping requirements;
receive your information in a portable format, where applicable law provides this right;
object to or restrict certain processing, where applicable law provides this right; and
file a complaint with a privacy regulator.
To make a request, contact us at hello@blastily.com. You may make a request yourself or through an authorized representative. We may need to verify your identity, and your representative's authority, before responding. We will respond within the time required by law, which is generally within 30 days in Canada, and will tell you if we need more time. We do not charge a fee for most requests. If we cannot fulfil a request, we will explain why, subject to legal restrictions. We will not treat you differently for exercising your privacy rights.
17. Automated Tools and Artificial Intelligence
We may use software tools, including artificial intelligence tools, to help draft content, transcribe meetings, and automate customer communications. These tools are used under human supervision, and we review their output before it is published or relied on. We do not make decisions that have legal or similarly significant effects on you based solely on automated processing. We take reasonable steps, including reviewing provider terms and settings, to protect confidential information entered into these tools.
18. Children's Privacy
Our Site and services are intended for adults aged 18 and over. We do not knowingly collect personal information from children under 13, or from minors for our messaging programs. If you believe a child has given us personal information, please contact us and we will delete it. If a client's Content includes a minor, the client must obtain consent from the minor's parent or legal guardian.
19. Accessibility of This Policy
We want everyone to be able to understand how we handle their information. This policy is available on request in alternative formats, such as large print, an accessible digital document, a plain-language summary, or read aloud by phone. To ask for an alternative format, contact us at hello@blastily.com or +1 (825) 736-2077, and we will respond within [5] business days. See also Section 18 of our Terms of Service and our Accessibility Statement at [ACCESSIBILITY STATEMENT URL].
20. Third-Party Websites and Platforms
Our Site, Deliverables, and published placements may link to or appear on third-party websites and platforms. We are not responsible for their privacy practices, and we encourage you to read their privacy policies.
21. Changes to This Policy
We may update this policy from time to time. We will post the updated version on the Site with a new "Last Updated" date and, for material changes, give reasonable notice by email, text message, or a notice on the Site. Where required by law, we will ask for your consent before using personal information in a materially different way.
